Following on from the application for permission to appeal, Kate Richmond was successful on the first ground of appeal under the Equality Act 2010.
Kate demonstrated to the court that her client’s lay representative was not given the opportunity to make adequate representations during the trial. The court found that the hearing did not protect her client’s Article 6 rights under the European Convention on Human Rights. The judgment against her client was set aside and her client was awarded their costs.
