Family agreements can end in tears. Families sometimes make agreements and put them in writing. Years pass and there are uncertainties about whether the agreements are valid and enforceable and what they mean. Paul Ashwell recently advised where a family which had tried to mix together an agreement about ownership of shares in a house with wills and a loan agreement. He was able to give clear advice on whether a court claim would win and who would be ordered to pay the costs.
